Sorry, but whether the rule violation was committed by yourself or someone else does not matter in this case. You alone are responsible for the actions of your character and for the security of your account, thus the banishment will stay.
I am sorry to hear that you have been hacked though. You have to find out how the hacker got access to your account and remove the security problem, else you risk being hacked again. Is it possible that you have a virus or a spy program on your computer? Please use one or two up-to-date virus scanners to check your computer. If a virus is found remove it before you do anything else. Did you share your account data with anybody? A person that knows your account data can easily hack you. Is your email address safe? Try to secure your email address by changing the email password.
To find out more about possible security leaks read the security hints at http://www.tibia.com/guide/?subtopic=security carefully. If you follow these guidelines your account should be well protected against any further hacking attempts.

As for changing e-mail address, you should be able to do that safely, once you have changed the accout password. Good luck.
